Booking Conditions
The following terms and conditions (the “Booking Conditions”) apply to all Applications made by Volunteers and any subsequent Placements taken by Volunteers.
Please take time to read them carefully, as they are written to protect your interests and set out our respective rights and obligations. You are bound by the terms of the Consent Form, the Placement Guidelines and the Booking Conditions, herein set out, upon The Leap’s receipt of your Deposit Fee and your Consent Form signed by you or on your behalf by your parent or guardian. You should accept these terms only if you have carefully read and understood the contents. Please note there may be additional conditions which apply to individual Placements. These will be set out on the relevant Placement Guidelines. Your contract further to your acceptance of the Booking Conditions is with The Leap Overseas Limited (herein referred to as “The Leap”), a company registered in England and Wales with company number 04383531 whose registered office is at Fleming Court, Eastleigh, Hampshire, S050 9PD.
The Volunteer’s attention is drawn specifically to:
(i) Clause 8 in relation to the limitation of The Leap’s liability; and
(ii) Clause 11 in relation to circumstances of The Leap’s amendment to Placements.
If you book a Placement through us, once your Placement has been confirmed we will accept responsibility for it in accordance with these Booking Conditions as an "organiser" under the Package Travel, Package Holidays and Package Tours Regulations 1992.
A package holiday for the purpose of the Package Travel Regulations 1992 is a combination of at least two elements out of (a) transport, (b) accommodation or (c) other tourist services (not ancillary to any transport or accommodation and forming a significant part of the arrangements) where booked through us at the same time, at an inclusive price, for which payment is made to us and which last at least 24 hours or include overnight accommodation.
1) We will accept responsibility for the arrangements we agree to provide or arrange for you as an “organiser” under the Package Travel, Package Holidays and Package Tours Regulations 1992 as set out below. Subject to these booking conditions, if we, or our suppliers, perform or arrange your contracted holiday arrangements negligently, taking into consideration all relevant factors (for example following the complaints procedure as described in these conditions and the extent to which ours or our employees’ or suppliers’ negligence affected the overall enjoyment of your holiday), we will pay you reasonable compensation. Please note that it is your responsibility to show that we, or our supplier(s), have been negligent if you wish to make a claim against us.
2) We will not be responsible or pay you compensation for any injury, illness, death, loss, damage, expense, cost or other claim of any description if it results from:-
(a) the act(s) and/or omission(s) of the person(s) affected;
(b) the act(s) and/or omission(s) of a third party unconnected with the provision of the services contracted for and which were unforeseeable or unavoidable; or
(c) unusual or unforeseeable circumstances beyond ours or our supplier(s) control, the consequences of which could not have been avoided even if all due care had been exercised; or
(d) an event which either ourselves or suppliers could not, even with all due care, have foreseen or forestalled.
A. DEFINITIONS AND INTERPRETATION
1. In these Booking Conditions the following words and phrases shall have the following meanings:
“Application” means an application made by a Volunteer for a Placement subject to the Booking Conditions, the Placement Guidelines and the Consent Form;
“Application Form” means The Leap’s application form, to be completed by the Volunteer;
“Briefing and Training Course” means the course The Leap arranges for Volunteers on which Volunteers are provided with information as to the nature of Placements and during which The Leap will assess the suitability of Volunteers for participation in a Placement;
“Brochure” means The Leap’s brochure and associated literature setting out the details of Placements and the related Project(s); and to which the Application Form is attached;
“Consent Form” means the form issued to the Volunteer by The Leap on the Volunteer returning the Application Form completed to the satisfaction of The Leap, through which the Volunteer (and if necessary the Volunteer's parent or guardian) shall confirm their consent to and acceptance of a Placement subject to the Booking Conditions, the Placement Guidelines and the Consent Form;
"Departure Date" means the date on or before which the Volunteer must arrive at the Destination Country, as specified in the Placement Guidelines;
“Deposit Fee” means the fee of £100 which covers the registration of the Volunteer by The Leap; the reservation of the Volunteer's Placement and his participation in the Briefing and Training Course or Interview and which is non returnable except in circumstances of the operation of clause 3.6;
“Destination Country” means the country in which the Volunteer’s chosen Placement is located;
“Force Majeure Event” any event which The Leap or the supplier of the service(s) in question could not, even with all due care, foresee or forestall, such as (by way of example and not of limitation) war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, abnormal weather conditions, acts of God and all similar events;
“Final Payment” means the payment of the balance of the Placement Cost;
“Interview” means the interview further to which The Leap will assess the suitability of the Volunteer for participation in a Placement, in circumstances where the Volunteer cannot attend a Briefing and Training Course;
“Placement” means the opportunity to take part in a Project provided to a Volunteer, in a form the same or similar to that set out in the Brochure (as amended by The Leap from time to time), on the Volunteer being deemed suitable for participation by The Leap and in return for the Volunteer’s payment in full of the Placement Cost according to the schedule for payment as defined by clause 10 of the Booking Conditions;
“Placement Location” means the location at which the Volunteers will be based for the duration of the Placement;
“Placement Cost” means the fees payable by the Volunteer to The Leap in respect of a Placement;
“Placement Guidelines” means the advice, instructions and guidelines in respect of the Volunteer's chosen Placement issued by The Leap to the Volunteer on The Leap’s receipt of the Volunteer’s satisfactorily completed Application Form;
"Project" means an ecological, civil or personal development project in which the Volunteer may participate subject to the terms of the Volunteer’s Placement;
“Schedule for Transfer” means the arrangements made by The Leap for the transport of Volunteers to their respective Placements;
“Second Payment” means the payment of £500, which covers planning and administration expenses incurred by The Leap in respect of the Placement;
"The Leap's Values" means the Leap's Values as referred to in the Placement Guidelines and published on The Leap's website from time to time;
“Work Placement Host” means the company, body or individual who manages the Project at which the Volunteer is placed subject to the Placement; and
“Volunteer” or “You” means the subject of the Application and the person named on the Consent Form as the Volunteer.
B. CONDITIONS
1. Age
1.1 Volunteers must be at least 18 years of age or over at the Departure Date, unless expressly agreed otherwise by The Leap. Each Volunteer will accurately certify his age on the Application Form and The Leap accepts such certification in good faith. The Leap reserves the right to cancel any Volunteer’s Application or terminate the Volunteer's Placement, if it has already begun, without any refund of any of the Placement Cost at that point paid in respect of the Volunteer’s Placement in the event that The Leap establishes that such certification has been falsely or inaccurately provided by the Volunteer.
1.2 If the Volunteer is less than 18 years old on signing the Consent Form, the Volunteer’s parent(s) or guardian will be required to countersign the Consent Form thereby accepting the Booking Conditions and in so doing agreeing to authorise The Leap to act in loco parentis for the Volunteer for the duration of the Volunteer's participation in a Placement.
2. Health
2.1 All Volunteers shall certify on the Application Form that they are of sufficient good health to take part in and complete a Placement.
2.2 Any Volunteer with a pre-existing or existing medical condition, illness, psychological/psychiatric condition (including depression and / or an eating disorder), serious behavioural issues, criminal conviction, or disability and / or who is undergoing any sort of medical treatment will disclose to The Leap full particulars of the same on the Application Form. The Leap reserves the right to refuse any Application as a result of any such disclosure, and The Leap's decision in these circumstances shall be binding and final.
2.3 The Leap will not be liable for any loss caused to the Volunteer or any third party as a result or in connection with any injury or pre-existing illness or other condition which the Volunteer fails to disclose in full on the Application Form, and the Volunteer shall indemnify The Leap in respect of any losses, liabilities, costs and expenses suffered by The Leap as a result of such pre-existing injury, illness or condition and / or the Volunteer’s failure to disclose the same.
2.4 The Volunteer shall immediately disclose to The Leap details of any medical condition, illness, psychological / psychiatric illness (including depression and / or eating disorder(s), behavioural issues, criminal convictions or disability which arise in relation to the Volunteer after The Leap’s receipt of the Volunteer’s Application Form and before the Departure Date. The Leap reserves the right to terminate the disclosing Volunteer’s Application and Placement on the basis of such disclosure if it considers that the Volunteer is no longer suitable for participation in a Placement, and The Leap’s decision in such circumstances shall be final and binding. Should The Leap terminate the Volunteer’s Placement in such circumstances, it shall refund to the Volunteer such portion of the Placement Cost already paid by the Volunteer which reflects the services not yet received by the Volunteer.
2.5 The Leap reserves the right to either refuse the Volunteer's Application or terminate the Volunteer's Placement without a refund of any of the Placement Cost thus far paid in respect of the Volunteer’s Placement in the event that The Leap establishes that:
2.5.1 the Volunteer has, in The Leap's reasonable opinion, falsely certified that he is of sufficiently good health to complete a Placement; and/or.
2.5.2 any disclosure made by a Volunteer in respect of their pre-existing or existing medical condition has been misleading, inaccurate or incomplete.
2.6 Any information provided by The Leap regarding health issues is given in good faith and can only constitute a general overview of the health hazards and requirements relevant to the Placement. As a result it is no substitute for specific and detailed medical advice and the Volunteer is accordingly advised to obtain such advice prior to the Departure Date.
2.7 All Volunteers must take all inoculations or medication within the requisite period before departure and during their Placement (as appropriate) as set out in the Placement Guidelines and should take advice from their GP or doctor as to additional inoculations or medication which their GP or doctor advises are necessary for them individually and/or advisory for the itinerary. The Leap reserves the right to:
2.8.1 inspect any Volunteer’s vaccination book at any time; and/or
2.8.2 to cancel any Volunteer's Application; and/or
2.8.3 terminate the Volunteer’s Placement without refund of any Placement Cost thus far paid by the Volunteer in the event The Leap establishes that the Volunteer in question has not received all the requisite inoculations or medication set out as required in the Placement Guidelines.
The Volunteer will be responsible for the payment of all costs associated with any inoculations or medications he is required to obtain prior to commencing and during a Placement, in order to take part in such Placement.
2.9 If, in the opinion of the medical staff of The Leap or the Work Placement Host (whose judgment in this matter shall be binding and final), the Volunteer's health deteriorates from time to time during the course of the Volunteer's Placement, or is adversely affected by activities which form part of the Placement, The Leap reserves the right to:
2.9.1 require the Volunteer to cease to or not participate in some or all of the activities available; and/or
2.9.2 terminate the Volunteer's Placement, if in the reasonable opinion of The Leap the Volunteer's health and safety (or the health and safety of others) is sufficiently endangered by the Volunteer's continuing presence on the Placement.
2.10 If The Leap terminates the Volunteer's Placement further to clause 2.9.2 above, The Volunteer shall not be entitled to be compensated in respect of the unexpired portion of his Placement. In these circumstances, The Leap advises the Volunteer to make a claim under any operative travel insurance policy the Volunteer may have in place.
2.11 All Volunteers should be aware that general standards of health, safety and hygiene in the countries to be visited will not be comparable to UK standards and of the risk of injury, fatigue and disease inherent in taking part in the type of experience offered by The Leap.
3. Selection
3.1 All Volunteers shall commence their Application by completing the Application Form and submitting it to The Leap. The Volunteer shall indicate his first choice Placement (the “First Choice Placement”) and shall nominate an alternative Placement (the "Nominated Placement") of the same or similar duration to the Volunteer's first choice Placement in completing the Application Form. Should the Application Form either:
3.1.1 be unsatisfactorily completed (at the discretion of the Leap); or
3.1.2 indicate that the Volunteer the subject of the Application Form is (in The Leap's sole opinion) unsuitable for participation in the Scheme
The Leap reserves the right to reject the Volunteer’s Application Form.
3.2 On its receipt and acceptance of the Application Form, The Leap will provide the Volunteer (in respect of his First Choice Placement):
3.2.1 a letter confirming the Placement itinerary, the Placement Cost and The Leap's required schedule for payment of the Placement Cost;
3.2.2 the Placement Guidelines;
3.2.3 the Consent Form; and
3.2.4 an invoice for the Deposit Fee.
3.3 On The Leap’s receipt of the duly completed Consent Form and the Deposit Fee (in cleared funds) from the relevant Volunteer, which must be received by The Leap no later than 14 days after The Leap’s issue of its invoice in respect of the same, The Leap will provide the Volunteer with a letter:
3.3.1 acknowledging and accepting its receipt of the Deposit Fee;
3.3.2 providing the Volunteer with at least one opportunity to complete the Briefing and Training Course and providing details of the circumstances in which the Interview will be available to the Volunteer; and
3.3.3 acknowledging and accepting the Volunteer’s offer to participate in a Placement, subject to his successful completion of the Briefing and Training Course or Interview.
3.4 All Volunteers are required to complete the Briefing and Training Course, unless The Leap agrees otherwise, in which case the relevant Volunteer shall complete the Interview. The Leap will not excuse a Volunteer from completion of the Briefing and Training Course unless the Volunteer provides The Leap with a reason for non-attendance, which is adjudged by the Leap (whose decision shall be final and binding on the Volunteer) as satisfactory.
3.5 The Leap shall assess the Volunteer’s suitability for participation in a Placement during the Briefing and Training Course or Interview. The Leap’s judgment as to the suitability of a Volunteer for participation in a Placement shall be binding and final. The Leap will notify the Volunteer in writing whether it views the Volunteer as suitable for participation in a Placement within 14 days of the Volunteer’s completion of the Briefing and Training Course or Interview. If The Leap considers a Volunteer suitable for a Placement, it will issue the Volunteer with confirmation of the Volunteer’s place on the Volunteer’s chosen Placement (the “Placement Confirmation”).
3.6 If The Leap finds a Volunteer unsuitable for participation in a Placement following the Volunteer's completion of the Briefing and Training Course or the Interview, The Leap will inform the Volunteer in writing and the Volunteer’s Placement will be terminated and The Leap will refund the Deposit Fee to the Volunteer and shall have no further liability to the Volunteer.
4. Travel Documents
4.1 It is the Volunteer’s responsibility to comply with such visa, passport and other travel documentation requirements as are necessary for the Volunteer's travel to and stay in the Destination Country for the duration of the Placement and The Leap will not be responsible for any Volunteer’s failure to comply with such requirements. The Volunteer is responsible for paying all costs associated with obtaining such documentation.
4.2 The Leap will not accept any liability if the Volunteer is refused entry onto any transport or into any country due to the failure on the part of the Volunteer concerned to carry or supply correct documentation.
4.3 The Leap may (at its sole discretion) assist the Volunteer in returning to his country of origin if the Volunteer is expelled from the Destination Country in the circumstances set out in clause 4.2, provided that the Volunteer will be liable to reimburse The Leap within 14 days of their return to their country of origin for any expenses incurred by The Leap in doing so.
4.4 The Leap can provide general information about the passport and visa requirements for the Volunteer’s Placement. The Volunteer’s specific passport and visa requirements and other immigration requirements should be confirmed by the Volunteer with relevant Embassies and/or Consulates. The Volunteer agrees to indemnify The Leap in relation to any costs which The Leap incurs as a result of the Volunteer’s failure to comply with any passport, visa, immigration requirements or health formalities.
Most countries now require passports to be valid for at least 6 months after the Volunteer’s return date. If your passport is in its final year, you should check with the Embassy of the country you are visiting. Non British Citizens, including other EU nationals, should contact the Embassy, High Commission or Consulate of your destination, for up to date advice on passport requirements.
5. Air Travel
5.1 Volunteers must arrange their own air travel and each Volunteer must confirm their air travel arrangements with The Leap in writing prior to booking the same.
5.2 A Volunteer must provide The Leap with proof of purchase and payment in full in respect of suitable air travel tickets to the Destination Country at least 60 days prior to the Departure Date.
5.3 On a Volunteer’s arrival at the Destination Country, providing that:
5.3.1 the Volunteer’s arrival coincides with The Leap’s Schedule for Transfer; and
5.3.2 the Volunteer arrives in the Destination Country at the airport or other point of entry specified in the Placement Guidelines as suitable for travel to the relevant Placement Location
The Leap will provide transport to enable the Volunteer to travel to their Placement Location once the Volunteer has arrived in the Destination Country; to the extent it is reasonably practicable for the Leap to do so. In circumstances where the Volunteer's arrival is not in accordance with clauses 5.3.1 and 5.3.2 above, the Volunteer shall be responsible for his travel to the Placement Location and shall pay any and all of The Leap's additional costs incurred in assisting the Volunteer in travelling in the Destination Country and to their Placement Location, should the Leap agree to provide such assistance (which shall be provided at the Leap’s sole discretion).
5.4 If the Volunteer does not arrive in the Destination Country within 5 days of the Departure Date, unless The Leap expressly agrees otherwise, the Volunteer shall be deemed to have cancelled his Placement and clause 12.5 shall apply.
6. Insurance
6.1 The Leap requires that Volunteers take out comprehensive insurance policies covering all risks normally considered as associated with adventure travel holidays and providing such levels of cover as required by The Leap (at its sole discretion). The Leap recommends the insurance policies provided by Global Travel Insurance Limited, which provides policies covering the risks associated with taking part in a Placement.
6.2 The Volunteer must provide The Leap with proof of valid and adequate personal travel insurance cover in respect of their Placement no less than 60 days prior to the Volunteer's Departure Date, covering the Volunteer in respect of at least the risks specified in clauses 6.1 and 6.3 and providing at least the levels of cover referred to in clauses 6.1 and 6.3, to the satisfaction of The Leap (whose judgement as to the adequacy of the Volunteer's insurance policy shall be binding and final). The Volunteer's failure to provide such proof of insurance shall entitle to The Leap to view the Volunteer as having cancelled his Placement and in such circumstances, clause 12.5 shall apply. The Leap accepts no liability for any deficiencies in the Volunteer’s insurance policy.
6.3 The Volunteer's insurance policy must cover the Volunteer in respect of the Volunteer’s personal accident and medical expenses to a minimum level of £2 million and shall cover the Volunteer's costs in circumstances of medical air rescue up to a minimum level of £2 million.
7. Placement
7.1 The Volunteer accepts, understands and acknowledges that, given the nature of Placements, the activities they involve and their locations, it is necessary for the Volunteer to adopt a flexible approach, allowing for the possibility of alternative arrangements being required. The Brochure and Placement Guidelines are therefore to be taken as indicative only as to the facilities and activities which will be made available to the Volunteer during the course of the Placement and not as a contractual obligation on the part of The Leap to be followed to the letter. The nature and extent of the facilities and activities which can be made available to you during your Placement are subject to a number of factors out of The Leap’s control.
7.2 During the Placement, management and support will be provided to the Volunteer by The Leap and the Work Placement Host for the period of the Placement, as described in the Brochure and Placement Guidelines.
7.3 Where possible, The Leap will use reasonable endeavours to assist the Volunteer with the Volunteer’s independent travel after the termination of the Volunteer’s Placement, where the Volunteer is travelling in the same country as the Placement. However, The Leap shall have no responsibility for the Volunteer’s safety or well being, or for the quality of the advice and assistance provided to the Volunteer by The Leap in respect of any period commencing after the termination of the Volunteer’s Placement.
7.4 Excursion or other tours that the Volunteer may choose to book or pay for independently before travel or whilst on a Placement (“Excursions”) are not part of the Placement, and are not provided by The Leap. The Leap is not party to agreements between Excursion providers and Volunteers and shall have no responsibility for the provision of the Excursion by the Excursion provider, nor for a Volunteer’s safety and well being, or the security of a Volunteer’s personal possessions, while a Volunteer is on a during an Excursion.
8. The Leap's liability
8.1 The Volunteer acknowledges that Placements are located in Destination Countries which are from time to time the subject of instability and upheaval. The Volunteer is expected to keep himself appraised of the general situation in the Destination Country of his chosen Placement and himself assess the risks of going to the Destination Country; reporting any concerns he has to The Leap and/or the United Kingdom Government Foreign Office. The Volunteer understands and accepts that that the Placement will involve elements of risk and that there are potential hazards involved, including (but without limitation) the possibility of injury, disease, discomfort, criminal activity, kidnapping, delay and loss of or damage to property. The Volunteer also acknowledges that The Leap has advised the Volunteer to take out appropriate insurance cover.
8.2 Nothing in these Booking Conditions limits or excludes the liability of The Leap for death or personal injury caused to the Volunteer resulting from The Leap’s negligence; or for any damage or liability incurred by the Volunteer as a result of fraud or fraudulent misrepresentation by The Leap.
8.3 The Leap will use reasonable skill and care in arranging and managing the Volunteer’s participation in the Placement. In order to make a claim against The Leap, the Volunteer must establish that The Leap has not used reasonable skill and care in arranging and managing the Volunteer’s participation in the Placement. The question of whether The Leap has provided the services, facilities and activities it organises and makes available to Volunteers with the necessary level of skill and care shall be assessed with reference to the laws and regulations applicable in the Destination Country in which they are provided.
8.4 The level of such compensation which may be paid to the Volunteer in the event that the Leap fails to provide a Placement in accordance with clause 8.3 will take into account all relevant factors including the Placement Cost, any steps it was reasonable for the Volunteer to take to minimise the loss suffered and the extent of the loss actually suffered by the Volunteer. The Leap shall have no liability in respect of any complaint or claim made by a Volunteer unless the Volunteer notifies The Leap of the claim or complaint in accordance with clause 14 of the Booking Conditions and agrees to assign to The Leap any rights the Volunteer has against any third party in connection with the relevant claim.
8.5 Except in the circumstances referred to in clause 8.2, The Leap's liability to the Volunteer or the Volunteer’s parent or guardian in respect of any matter or circumstances arising in relation to a Placement in any event, and howsoever incurred, shall be limited to the sum of the Placement Cost paid by the Volunteer.
8.6 For the avoidance of doubt, The Leap shall not be responsible for the actions or omissions of the Volunteer, or any liability, personal injury or loss of property caused to the Volunteer while the Volunteer is engaged in any activity:
8.6.1. not organized, managed or supervised by The Work Placement Host; or
8.6.2. which does not form part of the programme of activities in which the Volunteers is entitled to participate further to his Placement.
8.7 In all claims of whatever nature The Leap will not be liable where the alleged loss or damage results from any of the following:
8.7.1 the fault of the Volunteer affected; or
8.7.2 the fault of a third party not connected with the provision of the Placement which The Leap could not have predicted or avoided; or
8.7.3 an event or circumstances which The Leap or the supplier of a service offered to a Volunteer as part of a Placement could not have predicted or avoided even after taking all reasonable care; or
8.7.4 the fault of anyone who was not carrying out work for The Leap (generally or in particular) at the time.
8.8 Where the Volunteer’s Placement involves transportation (including (but not limited to) a flight or ferry crossing), The Leap’s liability will also be limited in accordance with and/or in an identical manner to:-
8.8.1 the contractual terms of the companies that provide the transportation for the Volunteers travel arrangements. The Volunteer acknowledges that all of the terms and conditions contained in those 'Conditions of Carriage' form part of the Volunteer contract with The Leap, as well as with the transport company and that those 'Conditions of Carriage' shall be deemed to be included by reference into this contract; and
8.8.2 any relevant international convention, for example the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation, which limit the amount of compensation that the Volunteer can claim for death, injury, delay to passengers and loss, damage and delay to luggage. The Leap is to be regarded as having all benefit of any limitation of compensation contained in these or any conventions.

8.10 Very rarely, The Leap may be forced to terminate or suspend an activity forming part of a Placement or a Placement itself on account of a Force Majeure Event (including (but not limited to) adverse weather conditions or political violence). In these circumstances, The Leap may decide it is necessary to evacuate Volunteers from the location of the activity or the Placement Location, or take such other measures as it shall deem (in its sole discretion) necessary in order to ensure each Volunteer’s safety and security. In such circumstances, the Volunteer shall reimburse The Leap its reasonable costs in providing for the Volunteer’s evacuation and / or undertaking such other measures as are necessary in order to ensure the Volunteer’s safety and security and the Volunteer hereby agrees that The Leap shall have no liability to the Volunteer in respect of any services or activities which the Volunteer cannot benefit from due to the relevant Force Majeure Event.
9. Obligations of Volunteers.
9.1 The Volunteer has carefully read and understood the Placement Guidelines, understands The Leap’s Values and what is expected of Volunteers. Accordingly the Volunteer agrees to and shall:
9.1.1 co-operate fully with and explicitly follow without delay all reasonable instructions given from time to time by The Leap, its directors, employees, contractors or agents or associates;
9.1.2 act in a reasonable and responsible manner towards those who come into contact with him during the course of the Placement;
9.1.3 wholly commit to and work hard towards the successful completion of the relevant Project throughout the course of his Placement;
9.1.4 obey local laws and regulations operative and observe and respect local customs applicable in the Destination Country and region of the Placement;
9.1.5 act in a peaceful and respectful manner to all persons, animals, plants and the environment;
9.1.6 fully reimburse The Leap, its agents and / or its representatives (including the Work Placement Host) for the cost of the repair or replacement of any equipment or possessions damaged or destroyed as a result of the Volunteer’s misuse of the same (which shall include use not in accordance with instructions provided by the relevant party);
9.1.7 adhere to The Leap's Values, the relevant Placement Guidelines and to carefully adhere to any further advice, briefings, instructions and guidelines issued by The Leap, its employees, contractors, agents or associates.
9.2 If the Volunteer materially fails to adhere to any obligation in clause 9.1 during the duration of the Volunteer's Placement, The Leap shall be entitled to:
9.2.1 provide the Volunteer with a written warning in respect of his behaviour in breach of clause 9.1, advising the Volunteer that the Volunteer has failed to comply with obligations as set out therein, and that if he does not alter his behaviour appropriately, The Leap reserves the right to terminate the Volunteer's Placement immediately and without refund and repatriate the Volunteer; and/or
9.2.2 terminate the Volunteer's Placement immediately and without refund whatsoever.
9.3 The Volunteer shall indemnify The Leap for any losses, liabilities, costs, expenses, fines or financial penalties incurred or paid by The Leap as a result of the Volunteer’s breach of his obligations as set out in clause 9.1.
9.4 For the avoidance of doubt, if The Leap has reason to believe that the Volunteer has taken (other than as prescribed to the Volunteer by their GP or doctor), sold or distributed drugs which are illegal in the United Kingdom; The Leap shall immediately terminate the Volunteer's Placement and shall repatriate the Volunteer. If applicable, the parents or guardian of the Volunteer shall be informed of the circumstances of the termination of the Volunteer’s Placement as soon as possible.
9.5 The decision of The Leap its directors, employees, contractors, agents and associates regarding any matter in respect of this clause and regarding the Volunteer's Placement is final.
9.6 If the Volunteer cuts short the Placement and returns home early in circumstances where there is no reasonable cause for complaint about the standard of the Placement provided, The Leap will not offer the Volunteer any refund for that part of the Placement not completed, or be liable for any costs incurred by the Volunteer in circumstances of his return to his country of origin. Depending on the circumstances, the Volunteer’s travel insurance may offer cover for curtailment.
10. Payment
10.1 The Volunteer is required to make the following payments at the following times, unless expressly agreed otherwise by The Leap:
10.1.1 within 14 days of The Leap receiving the completed Consent Form, the Volunteer must pay the Deposit Fee;
10.1.2 not less than 180 days prior to the Departure Date the Volunteer must pay the Second Payment;
10.1.3 not less than 60 days prior to the Departure Date the Volunteer must pay the Final Payment.
10.2 In the event that The Leap does not receive:
10.2.1 the Deposit Fee; or
10.2.2 the Second Payment and / or Final Payment in full in cleared funds when due, The Leap shall be entitled to deem the Volunteer as having cancelled his Placement, and in such circumstances, clause 12.5 shall apply.
10.3 If the Volunteer is 18 years old or over and has signed the Consent Form, the Volunteer is responsible for the payment of the Deposit Fee, the Second Payment and the Final Payment. If the Volunteer is under 18, the person who has countersigned the Consent Form on the Volunteer’s behalf is responsible for making such payments in accordance with these Booking Conditions.
10.4 Where any payment is made by The Leap on a Volunteer’s behalf in foreign currency (other than pounds Sterling) or in sterling drawn on a foreign bank, The Leap reserves the right to pass on to the Volunteer any bank charges it may incur in full in converting the payment made by the Volunteer into pounds Sterling and / or remitting such payment to its bank account.
10.5 The Volunteer shall be solely responsible for his costs in travelling to and from the Interview and / or the Briefing and Training Course, as well as any costs incurred by him in travelling to any airport in the United Kingdom or elsewhere prior to air travel to the Destination Country.
10.6 The Package Travel, Package Holidays and Package Tours Regulations 1992 require us to provide security for the monies that you pay for your Placement and for your repatriation in the event of our insolvency. For these purposes, The Leap protects monies that Volunteers have paid us in relation to their Non Air Package Placement, via a non Statutory Trust Account we have arranged with our bank, in respect of the balance of all Placement Costs paid in respect of Placements (i.e. in relation to any unexpired portion of a Placement) and any costs in relation to the repatriation of a Volunteer. Details of The Leap’s policies in respect of this matter are available on request. In addition the airline flights arranged on your behalf through STA Travel are ATOL bonded (3206) through the Civil Aviation Authority (CAA), they are fully protected ensuring you would be reimbursed in full or repatriated.
11. Alterations or Cancellation by The Leap.
11.1 The Volunteer accepts, understands and acknowledges that, given the nature of the Placements and their location in countries which are occasionally subject to change and upheaval beyond The Leap’s control, it is necessary for each Volunteer to adopt a flexible approach, allowing for the possibility of alternative arrangements. The outline itinerary as given for each Placement must therefore be taken as indication only of what each Volunteer may accomplish and not as a contractual obligation on the part of The Leap to be followed by the letter. The Volunteer should appreciate that the activities, schedules, itineraries, facilities and modes of transport may be subject to alterations without prior notice due to local circumstances or Force Majeure Events. Accordingly, and for the avoidance of doubt, The Leap, shall be entitled to make such reasonable alterations to the advertised details of Placements as it deems necessary, (either before or after the Departure Date). Most alterations which The Leap has to make to Placements are minor in nature. A minor change is any change which, taking into account the information the Volunteer has given to The Leap prior to the change being notified to the Volunteer, could not reasonably be expected to have a significant effect on the Placement applied for by the Volunteer and agreed by The Leap.
11.2 When a major change occurs, The Leap will notify the Volunteer in writing of the change without unreasonable delay and will give the Volunteer the choice of either accepting the change, or accepting (i) an Alternative Placement (as defined below); or (ii) a Deferred Placement (as defined below) in accordance with clause 11.4, or cancelling his Placement; in which case The Leap will provide the Volunteer with a refund for all the services which the Volunteer has not yet had the benefit of in accordance with clause 11.6. The Volunteer must inform The Leap in writing of his choice within 7 days of receipt of notice of the change and The Leap’s offer. If the Volunteer fails to do so, The Leap will be entitled to assume that the Volunteer has chosen to accept the major change or make alternative booking arrangements.
11.3 In all cases, except where a major change arises from a Force Majeure Event or Consolidation (as defined below), The Leap will pay the Volunteer, as a minimum, compensation as detailed below:

Compensation will not be payable if The Leap is forced to cancel, or in any way change a Volunteer’s Placement for reasons of consolidation due to the minimum numbers required for a Placement to be operated (as detailed in the Placement Guidelines) not being attained (“Consolidation”). The operation of all Placements is dependent upon a minimum number of Volunteers successfully applying to participate. If that number is not achieved, The Leap will have no choice but to cancel the Placement.
11.4 If The Leap is forced to make a major change to a Volunteer's Placement, The Leap shall provide written notice to the Volunteer of the major change in accordance with clause 11.2 and at the same time shall, providing The Leap considers that the Volunteer in The Leap's sole judgment is suitable for participation in such Placements, make available to the Volunteer the opportunity of participating in any of the following:
11.4.1 the Volunteer's First Choice Placement, but commencing as and when such participation becomes available or at a mutually convenient time (in circumstances of the postponement or cancellation of the Volunteer’s First Choice Placement (the "Deferred Placement"); or
11.4.2 the Nominated Placement either on a deferred basis (to commence at a mutually convenient time) or to commence on or around the same date as the Volunteer's First Choice Placement was scheduled to commence; or
11.4.3 where participation in either the Deferred Placement or the Nominated Placement is not available to the Volunteer, an alternative Placement of a similar nature and duration as the Volunteer's First Choice Placement (the "Alternative Placement") to commence either on or around the same date as the Volunteer's first choice Placement or on a deferred basis (at a mutually convenient time).
11.5 Where The Leap is forced to make a major change to the Volunteer's First Choice Placement as set out in clause 11.2 and The Volunteer agrees to participate in one of the Placements listed in clause 11.4 (a "Substitute Placement"):
11.5.1 the Volunteer shall no longer be entitled to a refund of any of the Placement Cost paid in respect of the Volunteer's First Choice Placement the subject of a major change, and shall no longer be entitled to take part in the same;
11.5.2 any refund to which the Volunteer would have been otherwise entitled (subject to clause 11.7) shall be set against the Placement Cost in respect of the Volunteer's chosen Substitute Placement.
11.6 The Volunteer's participation in the Substitute Placement shall then be subject to his payment of any remaining Placement Cost payable in respect of the relevant Substitute Placement (if any) as and when The Leap shall require such payment to be made, but in any event all additional costs payable by the Volunteer in respect of the Substitute Placement shall be paid prior to 14 days before the Departure Date in respect of that Placement, unless The Leap agrees otherwise in writing. Notwithstanding clause 11.5, if the Placement Cost in respect of the Volunteer’s Substitute Placement is less than that in respect of his First Choice Placement, The Leap shall refund to the Volunteer the sum of the difference on the Volunteer accepting the Substitute Placement.
11.7 If the Leap is forced to make a major change to a Volunteer’s First Choice Placement as set out in clause 11.2 less than 30 days prior to but before the Departure Date, or if there is no suitable Substitute Placement available to be offered to the Volunteer in accordance with clause 11.4; and the Volunteer does not or is not deemed to have accepted the major change, the Volunteer shall only be entitled to a refund in accordance with this clause 11.7. In such circumstances or if the Volunteer becomes otherwise entitled to a refund under these Booking Conditions, the Leap shall refund to the Volunteer the sum of the Placement Cost paid by the Volunteer at the time of the Volunteer's receipt of The Leap's notice of the necessity to make a major change to the Placement, less:
11.7.1 a sum equal to the sum of the Deposit and Second Payment actually paid by the Volunteer (whether paid separately or as part of a combined payment); or
11.7.2 the value of any benefits or services the Volunteer has thus far received from The Leap (whichever is the greater); and
11.7.3 in circumstances of The Leap having to make a major change to a Volunteer’s Placement as a result of a Force Majeure Event or due to Consolidation, any sums already paid by The Leap to the Work Placement Host and other applicable service providers in respect of the Volunteer's First Choice Placement, which are not retrieved or retrievable by The Leap.
11.8 Termination or major change after the Departure Date
11.8.1 Subject to clause 11.8.2, if The Leap is forced to terminate or make a material change to a Volunteer’s Placement after the Departure Date, The Leap will not be under any obligation to make any refund of any Placement Cost to the Volunteer and the Volunteer shall not be entitled to any compensation, or to require The Leap to meet any costs or expenses he may incur as a result of such major change or termination.
11.8.2 If for any reason after the Departure Date The Leap becomes, or becomes aware that it will be likely to be, unable to provide a significant proportion of the services which the Volunteer would otherwise be entitled to as part of the Placement, it shall attempt to make suitable alternative arrangements for the completion of the Volunteer’s Placement. If The Leap is not able to make such suitable alternative arrangements, or the Volunteer rejects them for good reason, The Leap will assist the Volunteer in returning to his point of entry to the Destination Country and will compensate the Volunteer in respect of the services and facilities forming part of the Placement that the Volunteer has not received the benefit of, where appropriate, unless The Leap has been forced to cancel the Placement due to a Force Majeure Event or Consolidation, in which case it shall be not required to provide any such compensation to the Volunteer. For the avoidance of doubt, The Leap shall not in these circumstances be responsible for purchasing on the Volunteer’s behalf, or assisting the Volunteer in purchasing tickets for travel from the Destination Country back to his country of origin, although The Leap will provide the Volunteer with guidance in relation to the purchase of tickets on the Volunteer’s reasonable request.
11.9 The Volunteer’s participation in any Substitute Placement in any circumstances shall remain subject to the Booking Conditions and the Consent Form and shall be subject to the Placement Guidelines in respect of such Substitute Placement.
11.10 The Leap shall in no circumstances be liable to any extent in respect of the Volunteer's or the Volunteer's parent(s) or guardian's expenses incurred in relation to the Volunteer's or the Volunteer's parent(s) or guardian(s) travel to:
11.10.1 any Placement subsequently cancelled or delayed or the subject of a major change by The Leap in the manner set out in clause 11.2; or
11.10.2 a Substitute Placement which a Volunteer is takes part in pursuant to the operation of clause 11.4. Yes – but only to the extent expressed in this clause]
11.11 In all circumstances where the Volunteer is unable to return to his country of origin following the termination of a Placement, The Leap shall use all reasonable endeavours to assist and offer guidance to the Volunteer in relation to his securing food and accommodation until such time as it is practicable for the Volunteer to return to his country of origin but for the avoidance of doubt shall be under no obligation under these Booking Conditions to assist the Volunteer in returning to his country of origin.
11.12 This clause 11 sets out the maximum extent of The Leap’s liability for any changes, postponements and cancellations to Placements as referred to herein. The Leap will not meet any additional expenses incurred by the Volunteer in accepting a change to a Placement or a Substitute Placement, or in returning to his country of origin, otherwise than as set out in clause 11.
12. Alterations or Cancellation by the Volunteer
12.1 A request by a Volunteer for an alteration to the details of the Volunteer's Placement will only be considered by The Leap if written notice of such a request is received by The Leap more than 60 days prior to the Volunteer's Departure Date, although The Leap may (at its sole discretion) consider requests for amendments to Placements after this date.
12.2 If a Volunteer requests that The Leap permit an amendment to any aspect of the Volunteer’s Placement (including the itinerary) in accordance with clause 12.1, the Leap will use its reasonable endeavours to accommodate the Volunteer’s request, provided that the Volunteer shall be required to meet all The Leap’s reasonable expenses incurred in meeting the Volunteer’s request and the Volunteer shall in all circumstances pay The Leap an administration fee of not less than £50.
12.3 All requests for cancellation of Placements must be made to The Leap in writing.
12.4 The sum of the refund receivable by a Volunteer on a Volunteer's cancellation of his Placement shall be calculated with reference to the table below.
When notice of cancellation received by The Leap (days prior to the Departure Date) - Refund
More than 90 days - Full refund of the Placement Cost , after the deduction of the Deposit Fee and the Second Payment.
90 to 60 days - 50% of the Placement Cost after deduction of the Deposit Fee and the Second Payment.
59 to 31 days - 25% of the Placement Cost after deduction of the Deposit Fee and the Second Payment.
30 to 0 days - No refund
If the Volunteer gives notice to The Leap of his wish to cancel their Placement more than 90 days prior to the Departure Date, The Leap may, at its sole discretion, refund the Volunteer a fair proportion of the Second Payment. In ascertaining what proportion of the Second Payment to refund to the Volunteer, The Leap will take into account the cost of any services the Volunteer has already benefited from.
12.5 Subject to applicable law, should the Volunteer terminate his Placement or be deemed to have terminated his Placement further to the terms of these Booking Conditions for whatever reason, whether before or after the Departure Date, the Volunteer shall not be entitled to a refund of any of the Placement Cost paid by the Volunteer to The Leap prior to his termination or the deemed termination of his Placement.
12.6 The Leap reserves the right to recover from the Volunteer or the person who has signed the Consent Form on behalf of the Volunteer any expenses The Leap may incur as a result of any late payment or failure to pay all or part of the Placement Cost by or on behalf of the Volunteer.
12.7 Notwithstanding any other provision of these Booking Conditions, if the Volunteer becomes aware that he will be unable to travel to the Placement Location or take part in the Placement, the Volunteer can transfer the Placement to another person, provided that:
12.7.1 the transferor notifies The Leap in writing not less than 60 days prior to the Departure Date in respect of the Volunteer’s Placement of his wish to transfer the Placement and provides to The Leap the full name and address of the intended transferee;
12.7.2 the transferee makes him or herself available for participation in an Interview, in order for The Leap to assess the suitability of the transferee for participation in the Placement;
12.7.3 the transferor returns all documentation thus far provided by The Leap and pays to The Leap an administrative charge of £25, as well as all reasonable additional costs and expenses incurred by The Leap with third parties in relation to the transfer of the Placement.
13. Pricing
13.1 The Leap reserves the right to impose amendments to or correct errors in the price of Placements, subject to this clause 13.
13.2 The price of the confirmed Placement is subject at all times to changes in transport costs; to cost changes arising from government action such as changes in VAT or any other government imposed changes; and to changes in currency exchange rates and to dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports any or all of which may result in a variation of the Placement price.
13.3 The Leap will absorb and the Volunteer will not be charged for any increase equivalent to 2% of the Placement Cost.
13.4 The Volunteer will be charged for the amount of any increase in the Placement Cost over and above the 2% referred to in clause 13.2. If this means that the Volunteer has to pay an increase of more than 10% of the Placement Cost (excluding the 2% which shall be absorbed by The Leap under clause 13.2) the Volunteer’s Placement shall be deemed to have been subject to a major change and the Volunteer shall be notified in writing by The Leap and provided with the choice of accepting the Placement (notwithstanding the increase to the Placement Cost); or a Substitute Placement in accordance with clause 11.4 (subject to clauses 11.5 and 11.6); or a refund in accordance with clause 11.7. The Volunteer must inform The Leap in writing of his choice within 7 days of receipt of notice of the change and The Leap’s offer. If the Volunteer fails to do so, The Leap will be entitled to assume that the Volunteer has chosen to accept the major change to the Placement deemed as having occurred as a result of the increase in the Placement Cost.
13.5 The Leap shall be entitled to either increase the sum of the Final Payment payable by the Volunteer by the sum of any additional Placement Cost payable (if practicable) or render an invoice to the Volunteer in respect of the additional Placement Cost payable, which invoice shall be paid by the Volunteer within 14 days of receipt.
13.6 Should the price of your Placement go down due to the changes mentioned above, by more than 2% of the confirmed Placement Cost, then any refund due will be paid to the Volunteer. However, please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the applicable Placement Cost.
14. Complaints
14.1 If during the Placement the Volunteer is unsatisfied with any aspect of the Placement, the Volunteer should in the first instance address the matter to the Work Placement Host and/or The Leap. The Leap and/or the Work Placement Host shall then investigate the Volunteer's complaint (the "Complaint") and following such investigation shall take such remedial action as they shall deem appropriate to address the Volunteer's dissatisfaction. If the Volunteer fails to promptly (within 7 days of the relevant matter arising) bring the Complaint to The Leap's and/or the Work Placement Host's attention, the Volunteer shall not be entitled to issue a claim in respect of the Complaint and The Leap shall have no liability to the Volunteer in respect of the Complaint.
14.2 If the Work Placement Host and/or The Leap is not able to resolve the Complaint to the Volunteer’s satisfaction and the Volunteer terminates his Placement, notwithstanding clause 12.5, The Leap may at its discretion and providing it is appropriate in The Leap's reasonable judgement to do so, offer the Volunteer the opportunity to participate in an alternative Placement, providing participation is available in an alternative Placement which:
14.2.1 is for a duration equivalent or similar to the remaining unexpired portion of the Volunteer’s Placement;
14.2.2 is located in the same continent as the Volunteer's current Placement; and
14.2.3 commences within 14 days of the date on which the Volunteer terminates his current Placement.
14.3 If a Volunteer agrees to participate in an alternative Placement offered to the Volunteer further to clause 14.2, the Volunteer shall be required to pay the full Placement Cost in respect of his participation in the alternative Placement and The Leap shall:
14.3.1 not be responsible for any additional costs incurred by the Volunteer or the Volunteer's parent(s) or guardian in travelling to or as a result of the Volunteer participating in the alternative Placement; and;
14.3.2 have no further liability in respect of the Complaint nor any other aspect of the terminated Placement.
14.4 The Leap will provide the Volunteer with details of the circumstances in which it would consider offering the Volunteer the option of participating in an alternative Placement as set out in clause 14.2 during the Briefing and Training Course and/or Interview; are on The Leap’s website (www.theleap.co.uk) and a list of these circumstances can be provided on the Volunteer's request.
14.5 If in the event of the Volunteer terminating his Placement as set out in clause 14.2:
14.5.1 The Leap does not offer the Volunteer an alternative Placement as set out in clause 14.2; or
14.5.2 the Volunteer does not accept The Leap's offer of an alternative Placement further to clause 14.2
The Leap may, at its sole discretion, on the Volunteer’s request, assist the Volunteer in returning to his country of origin, provided that the Volunteer shall reimburse The Leap in respect of any costs and / or expenses incurred by The Leap in providing such assistance within 14 days of his return to his country of origin.
14.6 If, in any event, the Volunteer on his return to his country of origin remains unsatisfied with the resolution of the Volunteer's Complaint, then the Volunteer must notify The Leap of his continued dissatisfaction in respect of the Complaint within 28 days of the termination of his Placement, giving full details of the Complaint. If the Leap and the Volunteer cannot then settle the dispute to the satisfaction of the Volunteer, the Volunteer must refer the Complaint to a recognised arbitration authority (which shall be an arbitrator recommended by the Year Out Group Limited) within 90 days of the termination of the Volunteer’s Placement, whose decision is binding and final.
15. Privacy Policy
15.1 The Leap shall be entitled to collect and / or retain information provided by the Volunteer on the Application Form, on The Leap’s website and from time to time, in relation to the Volunteer, including (but not limited to) the Volunteer’s name, address, email address, special needs, dietary requirements and travel preferences (the “Volunteer Information”) provided that it shall not disclose such information to any third parties except:
15.1.1 The Leap’s suppliers, agents and representatives (including its Work Placement Hosts) as necessary for the purposes of ensuring that the Volunteer’s Application and Placement is administrated efficiently; or
15.1.2 when required to do so by supplier’s of transportation, facilities and other activities which form part of the Volunteer’s Placement; or
15.1.3 when required to do so by public authorities such as customs or immigration authorities, or the police in the United Kingdom or the Destination Country; or
15.1.4 in the circumstances referred to in clause 15.2 or clause 15.3; or
15.1.5 when required to do so by law applicable in the United Kingdom or the Destination Country
unless the Volunteer agrees in writing to such disclosure.
15.2 By agreeing to these Booking Conditions, the Volunteer agrees that The Leap may provide the email address and telephone number supplied by the Volunteer to other Volunteers taking part in the same Placement as the Volunteer, and the parents or guardians of such Volunteers. Such disclosure permits Volunteers to get to know each other prior to the Departure Date and assists The Leap in co-ordinating the safe and efficient operation of the Placement.
15.3 Provided that the Volunteer has indicated his agreement to such disclosure on The Leap Feedback Questionnaire Form, The Leap may (after the Volunteer’s successful completion of a Placement) disclose the Volunteer’s name and email address to individuals considering applying for a Placement, Applicants and / or Volunteers, in order that the Volunteer may give the relevant individual an indication of the type of experience the individual can expect during a Placement. If the Volunteer at any time objects to such disclosure, The Leap shall without delay cease disclosing any of the Volunteer’s details as referred to in this clause.
15.4 Any likeness or image of the Volunteer secured or taken on any Placement may be used by The Leap without charge in all media (whether now existing or in the future invented) for bona fide promotional or marketing purposes, including without limitation promotional materials of any kind, such as brochures, slides, video shows and the internet.
16. Law and Jurisdiction
These Booking Conditions, the Consent Form and the Placement Guidelines and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales and the courts of England and Wales have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the these Booking Conditions, the Consent Form and the Placement Guidelines.
17. Notice
17.1 All Notices given to The Leap shall be in writing.
17.2 A Notice shall be deemed to have been duly and properly given to The Leap:
17.2.1 when delivered, if delivered by courier or other messenger (including registered mail) during the normal business hours of The Leap; or
17.2.2 when sent, if transmitted by fax or e-mail and a successful transmission report or return receipt is generated; or
17.2.3 on the third business day following mailing, if mailed by national ordinary mail, postage prepaid; or
17.2.4 on the tenth business day following mailing, if mailed by airmail, postage prepaid providing in each case such notice has been properly addressed to The Leap's address, e-mail address, or facsimile number as set out in the Brochure.
18. Severance
If any provision of this agreement (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of this agreement, and the validity and enforceability of the other provisions of this agreement shall not be affected.
19. Variation
To the extent permitted by applicable law, The Leap shall have the right to revise and amend the Booking Conditions from time to time without notice to the Volunteer and the Booking Conditions which shall be operative in respect of the Volunteer’s Placement shall be those operative on the Volunteer’s Departure Date.
20. Entire Agreement
Together with the Consent Form and the Placement Guidelines, these Booking Conditions constitute the entire agreement and understanding of The Leap and the Volunteer in respect of their subject matter and supersede and extinguish any previous agreement, understanding, undertaking, representation, warranty and agreement relating to their subject matter. The Volunteer acknowledges that it has not relied upon any statement, promise or representation made or given by or on behalf of The Leap which is not set out in the Placement Guidelines, the Consent Form or these Booking Conditions.
