Leap VIP Terms and Conditions

Leap VIP is a travel advice hub, we provide you with information regarding travel opportunities including flights, insurance and volunteering projects known as “opportunities”. Any recommendations regarding “opportunities” on the site are for the purpose of information and guidance only and we refer you directly to them.

The contract begins on the date and time that you join and pay for Leap VIP. The Fee of £150 is non-refundable and covers a 12 month subscription. You can transfer your Leap VIP fee in full as a credit and deposit against any Leap program free of charge, which will be deducted from the cost of the program and can be transferred between different programs and dates so provides you with complete flexibility.

It is your responsibility to check the FCDO advice before you travel and if you choose to travel to a country on a UK red list or travel contrary to any FCDO travel advice that is at your own risk.

Managing Expectations – Emergency Assistance Not Provided

Leap VIP is a service that for a modest annual cost covers general travel advice. Leap VIP is not an emergency service providing 24/7 support, rescue or assistance should you get into trouble whilst travelling overseas. Consequently Leap VIP has no legal or contractual obligation to provide any emergency assistance. That said where possible on an informal basis we would be happy to help provide any advice and support where we reasonably can within office hours (if that becomes extensive we may have to charge a fee for our time). If you are facing an emergency you should contact your local embassy/consul for assistance, travel insurer (if medical/accident), local emergency services (police etc). We recommend you purchase Pharos membership (highlighted in Leap VIP) who also provide 24/7 advice, support, risk and crisis management. No company can provide real time advice on every event that may be occurring in a country at any given time. It is therefore your responsibility to keep yourself informed on a daily basis on events that could affect your safety or travel plans (strikes, blockades, protests, civil war, terror attacks etc), especially before moving from one region/country to another, using the FCO travel advice, local media, internet and asking local people.

Awareness of Risk

We wish to make clear that travel may involve an element of risk; in particular, but not limited to, the risk of wild animals, forces of nature, accident through travel or transportation, in-country disruption of services by war or political unrest.

It is therefore important that you do your own research and risk assessment prior and during travel, accordingly Leap VIP cannot be held responsible for any such risks or have any legal responsibility/liability what so ever for any advice/information on this site or for accidents, illness or issues caused to you by the negligence of 3rd parties you may have engaged or booked with.

You are responsible for your own actions and as such will take all relevant and necessary precautions in all activities, and accordingly you will need proper and comprehensive travel insurance cover in respect of these risks to be in place prior to travel. Including to comply with any local rules and/or laws including, but not limited to, dress and/or behaviour.

Health advice

Any medical or health information is not intended to be nor is it to be regarded as an alternative to professional medical advice to a specific medical condition or enquiry. ALWAYS seek the advice of your doctor for any questions you may have regarding a medical condition or obligation before considering an “opportunity” or before travelling.

Copyright policy

The copyright on this website belongs to Leap VIP. All intellectual property rights are reserved. You may not alter, duplicate, dispense, convey, display, execute, duplicate, circulate, certificate, plagiarise, transmit or trade any information obtained from this website.

Liabilities

Our liability based on the service we provide is as follows. You agree to these restrictions in full by reading and using this site. You agree that matters between Leap VIP and yourself will be governed by the use of English law.

Your opportunity

As we only act as a referrer/introducer; you pay the individual or organization yourself providing the “opportunity”. Your contract will be with them (“opportunities”) and them only and they are fully liable for every aspect of their product that you buy, according to their own terms and conditions. So you need to check these in full before you book.

On this site there are many “opportunities” that allow you to book direct with the source and not necessarily via a travel agent or tour operator offering a package. As financial security bonding regulations differ in each country we highly recommend you ask how your money is protected directly with the organization/individual you are booking with, or take out personal travel insurance that covers the failure of the holiday provider. If you are buying your flight separately and not as part of a package then ensure that the company selling you the flight has the equivalent of a British ATOL bond.

Legal Disclaimer

We do our best to provide up to date information, however as rules and regulations are fluid and change frequently with no notice, Leap VIP cannot be expected to be accurate at all times. We therefore do not accept any legal responsibility for the accuracy of any information provided either verbally, in writing or via the website. Or for any errors or omission’s we may inadvertently make, as entry regulations are complex, ambiguous and often in a different language. You need to do your own research and get a second opinion from a trusted source like Trailfinders to ensure you are confident you comply with any laws and regulations. Leap VIP is not liable in anyway for any failures by you to obtain and comply with the correct legal requirements prescribed by the country you are visiting or for any costs, aggravation or expenses incurred as a result.

It is your responsibility to ensure that you keep up to date with and comply with all legal requirements and local laws to enter, travel, live, holiday and work in any country you visit. For example by arranging appropriate visas and checking you comply with entry requirements (such as any PCR/Antigen or covid vaccinations) prior to travel. You can do this by checking the travel advice/entry requirements via the Foreign & Commonwealth Development Office (FCDO) website for the country you are visiting. You also need to check the entry requirements on the local country government website (as this information may differ from the FCO). Lastly we recommend you book flights via the corporate team at Trail Finders (TF) who have a department dedicated to providing up to date travel advice, ensuring you can check advice with TF.

Leap VIP do not accept any legal responsibility for or offer any assurance in any way for the competence or criteria of any of the “opportunities” that you are sold. You must have sufficient medical insurance including medical repatriation. Leap VIP is not legally responsible or liable for any injury and/or damage to persons or property happening during or as a result of any “opportunities” taken as a result of enquiries made through this website.

Quality of opportunity providers

“Opportunities” listed on this site are provided by many individuals and organisations around the world. We cannot vet the content or guarantee their ability to provide you with a quality product or service. You need to carry out your own research before you book or enter into a contract by asking questions, speaking to past clients, reading online reviews etc to satisfy yourself.

If we are alerted by you to bad practice by any of our “opportunity” providers we will immediately investigate the matter and take appropriate action in advising them to correct their service or remove them from the site.

Cancellation

Where you are a consumer as defined in The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 SI 2013/3134 you have the legal right to cancel your order up to 14 calendar days after the day on which the contract is entered into, the contract begins on the date and time that you join and pay for Leap VIP, (the Cancellation Period).You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty (unless we have begun the services within the Cancellation Period in accordance with clause 1 below).

  • If you require us to begin the services within the Cancellation Period we require you to request to do so (such as book your consultation).In such cases, your right to cancel continues until either the end of the Cancellation Period, or the completion of the services, whichever is the earlier.If you cancel during the Cancellation Period we may charge you for any services provided up until the point when we receive your cancellation notice, and will provide a partial and proportionate refund accordingly.Your right to cancel the services will no longer apply once the services have been fully performed.
    • the act(s) and/or omission(s) of the person(s) affected; or
    • the act(s) and/or omission(s) of a third party unconnected with the provision of the services contracted for and which were unforeseeable or unavoidable; or
    • unusual or unforeseeable circumstances beyond ours or our ‘opportunities(s)’ control, the consequences of which could not have been avoided even if all due care had been exercised; or
    • an event which either ourselves or opportunity providers could not, even with all due care, have foreseen or forestalled.

On booking Leap VIP we will invite you to attend a travel advice consultation within the 14 day cancellation period or at a date convenient with you and ask you to advise us of your consultation date via the calendar booking on Leap VIP or by email. If we provide you with a consultation within the 14 day cancellation period there will be no refund of the fee if you cancel within 14 day cancellation period. If you cancel within the 14 day cancellation period and you have not had the consultation we will refund £50 (less the bank charge taken by the card payment service/stripe when we received your payment) and retain £100 for the package travel and educational services: advice, information, specialist flight, safety back-up and travel insurance partnerships, overseas projects and agents, comprising Leap VIP’s intellectual property, provided by many months of staff work and research for the benefit of any Leap VIP member, which you have received when joining Leap VIP by being provided with access to all the advice on Leap VIP. Whether you chose to view it or not, you cannot reasonably claim by accessing the site and the information available that you have not had access to the service outlined above.

If you wish to cancel your membership you need to contact us by email to info@theleap.co.uk and your date of cancellation will be taken from the time we receive and open/respond to the email. If you cancel after the cancellation period the fee is non refundable.

Complaints

We make every effort to ensure that we provide a good service. You must advise us of your complaint within 7 days of the relevant matter arising. If you do not raise any issues we will have been prevented from having the opportunity to investigate, address and rectify the situation, and as a result you shall not be entitled to issue a claim in respect of the complaint and The Leap shall have no liability in respect of the complaint. If you are unhappy with our resolution you can refer your complaint to a recognised arbitration authority within 90 days of the complaint, whose decision will be binding and final.

The maximum amount we will have to pay you in respect of a claim is the price paid by or on behalf of the person(s) affected in total i.e. £150. This maximum amount will only be payable where everything has gone wrong and you or your party has not received any benefit at all from your booking.

Our Responsibilities:

As Leap VIP is simply a travel advice hub we are not therefore responsible or have any legal responsibility/liability what so ever for any advice/information on this site or for your failure to take personal responsibility to check and keep up to date by comparing any advice on this site with other trusted 3rd parties/sources or for accidents, illness or issues caused to you by the negligence of 3rd parties you may have engaged or booked with.

We will not be responsible or pay you compensation for any injury, illness, death, loss, damage, expense, cost or other claim of any description, if it results from:

  • the act(s) and/or omission(s) of the person(s) affected; or,
  • the act(s) and/or omission(s) of a third party unconnected with the provision of the services contracted for and which were unforeseeable or unavoidable; or,
  • unusual or unforeseeable circumstances beyond ours or our ‘opportunities(s)’ control, the consequences of which could not have been avoided even if all due care had been exercised; or
  • an event which either ourselves or opportunity providers could not, even with all due care, have foreseen or forestalled.

Jurisdiction, disputes and applicable law

These Terms and Conditions and any agreement to which they apply are governed in all respects by English law. We both agree that any dispute, claim out of or relating to this Statement or other matter will be dealt with by the Courts of England and Wales only. If anyone brings a claim against us related to your actions, content or information on Leap VIP, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.
